Objections by the Lord of the Manor or his representative against the findings of a Jury of Survey. Excepcons to the Jurey of Survay in Musgrave and Soulby in the yeare 1656 M O 3 No/1 ~~~~~~~~~~~~~~~~~~~~~ County of } Exceptions against the Verdict of the Jurye of Survay Latly mad for Westmorland } the Mannors of Great and Litle Musgrave Soulby and Kirkby Stephen:/ 1 First they doe not say in the said verdict of what Court they were chosen or by what Authorety or what there Charge was 2 G They have Incerted into the said verdict severall men to be the Lords Tennents which at that tyme was not:/ 3 G They have not mad up a perfect Rentall of the Lords Rent but comes much short in the Manor of Soulby although that they had severall accompts that did show them the contrary:/ 4 They have not mad a perfect note of boones and servisses but haith omitted severall formerly due as in TEBAs case:/ LANCASTERs case blacke booke Indenture 5 They have omitted what the Tennents servis is to the Milner of Musgrave and Soulby what every mans particular part of wall Thatch and dam is what the Moulter is which was given them in Charge:/ 6 They have omitted to sett downe what Costomary bigg was pad by the Tennants of Soulby who should pay the same what bushels or peckes every one should pay and what tyme of the yeare and what the Mesure was Anncently this they have omitted which was given them in Charge and have sett downe moneys in stead therof fore short of the value:/ 7 They have omitted to give an accompt what was the Anncent Amerciments for such Tennants as did not doe the Lord suite of court or servis to his Milne and Kilne:/ 8 They have omitted to present all Improvements of the Lords Common 9 They have omitted to make up a particular of the boundes of the Mannor or Lordship of Soulby:/ which was given in Charge 10 They have omitted to make up a particular of the severall names of Closses and Lands with there particular Rents and servisses belonging to the Indenture Tennants so That Indenture Tennants might Land might be distinguished from Arbitrary Land which causses a great confusion and severall cheats ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ All thesse particulars they have omitted which was the Cheife end for which the Lord mad Choyse of theme for:/ to his great damage and almost Imparable Losses by there Infusing in to the said verdict severall shewing [?] new opinions of there owne Invencon concerning there Costome which I shall prove is contrary to all the former Costome used in the said Mannors and is alredy confessed by some of the Jurrours to be false and eronouis
